Terms of Service
The agreement
These terms are an agreement between you and Orbis Systems LLC ("Orbis," "we," "us"). By creating an account or using the Orbis register, dashboard, or orbismerchant.com, you accept them. If you're accepting on behalf of a business, you confirm you're authorized to do so.
The service
Orbis provides point-of-sale software, an owner dashboard, and related tools for retailers and wholesalers. We work to keep the service available and improving, and the register is designed to keep ringing up sales even when the internet drops. We may add, change, or retire features over time and will give reasonable notice of material changes.
Orbis provides the software only. The stores that use Orbis are solely responsible for their own goods, sales, prices, and returns; refunds for a purchase are handled by the store where it was made, under that store’s own return policy.
Accounts & staff
You're responsible for your account, for the cashiers and managers you invite, and for keeping PINs and passwords confidential. Assign each person their own login so sales and actions are attributable. Tell us promptly if you believe an account has been compromised.
Hardware
On approved accounts we provide your register hardware — including the card reader — at no cost, and it is yours to keep. Your monthly plan includes hardware protection: if a device fails under normal use, we ship a replacement the next business day where available. Damage from misuse, loss, or theft isn't covered. Hardware is configured for use with the Orbis service.
Fees & processing
Your software fee and card-processing rates are set out in your order or subscription agreement, confirmed in a free consultation before you sign. Fees are billed as described in that agreement, and taxes may apply. There is no long-term contract, and you can cancel at any time; fees already incurred are non-refundable.
EBT & WIC compliance
Orbis supports EBT/SNAP and WIC transactions where you are an authorized retailer. You are responsible for maintaining your own authorizations and for following program rules; we provide the tools and reasonable help with applications, but we do not control eligibility decisions made by the programs or their processors.
Acceptable use
- Use Orbis only for lawful sales and business operations.
- Don't attempt to break, overload, reverse-engineer, or resell the service.
- Don't process transactions that violate card-network rules or applicable law.
- Keep your product, tax, and pricing information accurate.
Termination
You can close your account at any time from settings or by contacting us. We may suspend or end service for non-payment, violation of these terms, or to comply with law or network rules — with notice where practical. On closure you can export your data for a reasonable period before deletion.
Warranties & liability
The service is provided "as is" without warranties beyond those that cannot be excluded by law. To the fullest extent permitted, Orbis is not liable for indirect or consequential losses, and our total liability for any claim is limited to the software fees you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the Orbis service will be brought exclusively in the state or federal courts located in New York, New York, and you and Orbis consent to the jurisdiction of those courts.
SMS Program
Orbis Core sends transactional text-message receipts on behalf of participating stores. A customer opts in at checkout by selecting a text receipt; one message is sent per receipt requested. Reply STOP to opt out, reply HELP for help, and message and data rates may apply. Full details are in our SMS Program.
